What do you need to be aware of when streaming music commercially?

The majority of business owners are unaware that popular music streaming services such as Spotify or Apple Music are not licensed for commercial use in businesses such as shops or restaurants. Whether you run a restaurant, a gym, a hotel or a shop, it is very likely that you have music playing in the background. This already constitutes commercial use of the music, which means you have to comply with specific requirements, such as registering and licensing the tracks played accordingly. Services such as Spotify, Deezer, Apple Music, Tidal, YouTube and Amazon Music do not fulfil these requirements for licensed music for commercial use.

What do you need to consider to legally stream music in your business?

Due to copyright law, fees are incurred when streaming music to ensure that artists are remunerated for the use of their work. Streaming services such as Spotify are licensed for private use and do not pay any fees for the necessary broadcast licences for public playback. This means that these services should not be used for commercial purposes. You as a business owner or your employees are not authorised to play music from B2C services such as Spotify in your business, even if you use a paid subscription.

Businesses (such as bars, restaurants, schools, shops, hairdressing salons, dance schools, radio stations, etc.) are therefore not allowed to broadcast or play Spotify publicly.
